Information on data transfer to the USA and other third-party countries
We use, among others, tools from companies that are based in the USA or other non-EU countries where data protection cannot be guaranteed. 7. Audio and visual conferences

Data processing
Among others, we use online conference tools to communicate with our customers. The individual tools that we use are listed below. When you communicate with us by video or audio conference via the Internet, we and the provider of the respective conference tool record and process your personal data. The conference tools record all the data that you provide/enter when you use the tools (e-mail address and/or your telephone number). The conference tools also process the duration of the conference, the beginning and end (time) of your participation in the conference, number of participants and other “contextual information” in connection with the communication process (metadata). The provider of the tool also processes all technical data that is necessary to execute the online communication. This includes in particular IP addresses, MAC addresses, device IDs, device type, operating system type and version, client version, camera type, microphone or loudspeaker as well as the type of connection. If any content is exchanged, uploaded or made available in some other way, this content will also be stored on the servers of the tool provider. Such content includes in particular, cloud pictures, chat/instant messages, voicemails, uploaded photos and videos, files, whiteboards and other information that is shared while using the service. Handling applicant data
We offer you the opportunity to submit your application to us (e.g. by e-mail, post or via the online application form). We confirm that your data shall be collected, processed and used in accordance with applicable data protection law and all other statutory provisions, and that your data shall be treated in the strictest confidence.

Scope and purpose of the data collection
When you send us an application, we will process the related personal data (e.g. contact and communication data, application documentation, notes related to job application interviews, etc.), insofar as this is required to make a decision on establishing an employment relationship. The legal basis for this is Art. 26 of the Federal Data Protection Act (BDSG) (Initiating an employment relationship), Art. 6 para. 1 letter b GDPR (General initiation of a contract) and – if you have granted your consent – Art. 6 para. 1 letter a GDPR. Data retention period
If we are not in a position to make you a job offer, you turn down a job offer or you withdraw your application, we reserve the right to retain the data that you submitted on the basis of our legitimate interests (Art. 6 para. 1 letter f GDPR) for up to 6 months after the end of the application process (rejection or withdrawal of the application). Then the data will be deleted and the physical job application documentation will be destroyed. Retention is for the purposes of verification in the event of a legal dispute. Provided it is clear that the data will be required after the 6-month deadline expires (e.g. due to an imminent or impending legal dispute), it will only be erased if the purpose for further storage no longer applies. Acceptance into the applicant pool
If we do not make you a job offer, we can include you in our applicant pool if necessary. If your application is accepted, all documents and details arising from the application will be transferred to the applicant pool in order to contact you in the event of suitable vacancies. Various types of data are processed when you use Microsoft Teams. The scope of data also depends on what type of data and information that you share before or during an online meeting.

The following personal data is the subject of the processing:

User information: e.g. display name, e-mail address, profile picture (optional), preferred language

Meeting metadata: e.g. date, time, meeting ID, telephone number, place

Text, audio and video data: You have the option of using the chat function in an online meeting. Your text entries will be processed to the extent that you can display them in the online meeting. To allow the displaying of video and audio playback, data from your device’s microphone and any video camera of the device will be processed accordingly for the duration of the meeting. You can disable or mute the camera or the microphone yourself at all times, even via the Microsoft Teams applications.

Scope of the processing

We use Microsoft Teams to run online meetings. If we intend to record online meetings, we will inform you transparently in advance and – if required – seek your consent.

The chat content is logged when Microsoft Teams is used. We store the chat content for a period of up to three months. We will log the chat content if it is necessary for the purposes of recording the results of an online meeting. However, that will not usually be the case.

Automated decision-making within the meaning of Art. 22 GDPR will not be used.

Legal basis for the data processing

If the personal data of employees of the controller is processed, Art. 26 BDSG shall be the legal basis for the data processing. If personal data connected with the use of Microsoft Teams is not required to establish, perform or terminate the employment relationship, irrespective of whether it is an elementary component of the use of Microsoft Teams, Art. 6 para. 1 letter f GDPR shall be the legal basis for the data processing. In such cases, our interest is in the effective running of online meetings.

Furthermore, the legal basis for data processing during the running of online meetings shall be Art. 6 para. 1 letter b GDPR, if the meetings are run within the scope of contractual relationships.

If no contractual relationship exists, the legal basis shall be Art. 6 para.1 letter f GDPR. In this case, our interest is also in the effective running of online meetings.

Recipients/sharing of data

Personal data that is processed in connection with participation in online meetings will generally not be shared with third parties if it is not specifically intended to be shared. Please note that the content from online meetings as well as personal discussion meetings often serves to communicate information with customers, interested parties or third parties, and is thus suitable for disclosure.

Further recipients: The provider of Microsoft Teams will receive necessary information about the above data if this is intended within the scope of our contact on order processing or EU standard contract clauses with Microsoft Teams.

Data processing outside the European Union

There is generally no data processing outside the European Union (EU) as we have limited our storage location to data processing centers in the European Union. However, we cannot rule out that data is routed via Internet servers that are located outside the EU. This may be the case, in particular, if participants in an online meeting are located in a non-EU country.

However, the data is encrypted during transport over the Internet, which protects it from unauthorized access by third parties.

Erasure of data

We delete personal data principally when we are not required to store it further. A requirement may exist in particular if the data is still needed to fulfill contractual services, guarantee performance or for verification, guarantee or defense of guarantee claims. In the case of statutory retention obligations, data will be erased only after the respective retention obligation has expired.

Which of your personal data do we process? For what purpose?

When we receive data from you, we process it only for the purposes for which we collect/have collected it.

Data processing for other purposes may be considered only if the required legal basis exists in accordance with Art. 6 Para. 4 GDPR. We shall observe any information obligations in accordance with Art. 13 para. 3 GDPR and Art. 14 para. 4 GDPR in any case.

What is the legal basis for data processing?

The legal basis for the processing of personal data is principally – insofar as there are no other specific legal regulations in this regard – Art. 6 GDPR. The following are particularly relevant in this case:

How long is the data stored?

We process the data for as long as it is required for the purpose in question.

If there are existing statutory retention obligations – such as in the area of commercial or tax law – the affected personal data will be stored for the duration of the retention obligation. After the retention obligation has expired, we will check whether it is necessary to continue the processing. If there is no longer a need to do so, the data will be deleted.

To whom is this data disclosed?

Your personal data will be shared with third parties only if this is necessary to perform the contract with you, if the sharing of said data is permitted on the basis of weighing up legitimate interests within the meaning of Art. 6 para. 1 letter f GDPR, if we are legally obligated to share it on, or insofar as you have given your consent.

Right to lodge a complaint with and to seek advice from the company’s data protection officer

Every data subject shall have the right to complain to or seek advice from the company’s data protection officer in accordance with Art. 38 of the General Data Protection Regulation (GDPR). The company’s data protection officer is therefore obligated to maintain confidentiality and secrecy.
